This Wednesday, September 16, the European Parliament registered one of the most scandalous sessions in its history, in relation to a Polish legislative project.<\/p>\n
A popular legislative initiative against pedophilia<\/big><\/p>\n Last year Counting Stars reported on the popular legislative initiative \"Stop Pedofilii\"<\/a> (Stop Pedophilia) which was supported by more than 265,000 signatures and brought to the Sejm (the Polish Parliament) for processing. It is an initiative that has received the support of the Prawo i Sprawiedliwo\u015b\u0107 (PiS, Law and Justice) party, which governs Poland<\/a>. Before the defamatory campaigns that this initiative suffered, its promoters already warned that it is a lie<\/a> that it is directed against \"teachers, educators or doctors who warn children against venereal diseases, sexual harassment and pornography or inform them about biological development of man\"<\/em>.<\/p>\n Offensive in Brussels against the Polish anti-pedophilia initiative<\/big><\/p>\n Despite this, in November of last year the European Parliament passed a resolution condemning this initiative<\/a>, which they accused of \"criminalisation of sexual education in Poland.\"<\/em> The Polish initiative against pedophilia was also criticized in the report prepared by the Spanish socialist MEP Juan Fernando L\u00f3pez Aguilar, which we already saw here<\/a>. Precisely, yesterday the European Parliament approved that report<\/a>, including in its point 54 a criticism of this project against pedophilia, stating that \"de facto seek to criminalise the dissemination of sexual education to minors.\"<\/em> A lie that the Group of Conservatives and Reformists (ECR) replied yesterday through an amendment that was rejected<\/a>, as revealed by the MEP of Vox Jorge Buxad\u00e9, belonging to the ECR.<\/p>\n Buxad\u00e9 pointed out<\/a> that MEPs from the European People's Party voted against the ECR amendment, with the exception of the 13 deputies from Fidesz <\/strong>(the party that governs Hungary). It is the same situation that occurred on July 16<\/a> when the report was approved by the Committee on Civil Liberties, Justice and Home Affairs of the European Parliament. \"Can't a sovereign State legislate in its Parliament to protect children and the balanced and harmonious development of their powers, including sexuality? Or directly to the EP it seems wrong to prohibit the promotion of pedophilia?\"<\/strong><\/em>, Buxad\u00e9 asked, who added that all Spanish deputies except those of Vox have voted in favor of this point, rejecting the \"Stop Pedofilii\" project.<\/a><\/p>\n What the Polish Penal Code currently says about promoting pedophilia<\/big><\/p>\n Given the falsehoods spread by the European Parliament about this project against pedophilia, and following the traditional line of Counting Stars of offering its readers direct access to news sources, we are going to see what that project says below.<\/strong> Currently, Article 200b of the Polish Penal Code (see PDF)<\/a> consists of a single point that penalizes the public promotion of pedophilia. Here's what that article says:<\/strong><\/p>\n In Polish:<\/strong> \"Art. 200b. Kto publicznie propaguje lub pochwala zachowania o charakterze pedofilskim, podlega grzywnie, karze ograniczenia wolno\u015bci albo pozbawienia wolno\u015bci do lat 2\".<\/em><\/p>\n In English:<\/strong> \"Art. 200b. Whoever publicly promotes or approves the conduct of a pedophile will be punished with a fine, restriction of freedom or imprisonment of up to 2 years\".<\/em><\/p><\/blockquote>\n What the project 'Stop Pedofilii' proposes to add<\/big><\/p>\n The \"Stop Pedofilii\" project intends to add three more points to that Article 200b<\/strong> (those indicated with numbers 2, 3 and 4). One note: the ellipsis that appear in the second line are due to the fact that the date of the law should be indicated on that site once it is approved. In the Law of June 6, 1997 - Penal Code (Official Gazette of 2018, article 1600, as amended), Art. 200b is replaced by the following:<\/p>\n \"Art. 200b. \u00a7one. Anyone who publicly promotes or approves pedophile behavior<\/strong> will be punished with a fine, restriction of freedom or imprisonment of up to 2 years.<\/p>\n \u00a72. The same punishment applies to anyone who publicly encourages or endorses sexual relations with a minor.<\/strong><\/p>\n \u00a73. If the perpetrator commits the act specified in \u00a72 by mass communication<\/strong>, he will be punished with imprisonment for up to 3 years.<\/p>\n \u00a74. Whoever promotes or approves the participation in sexual relations or other sexual activity by a minor<\/strong>, acting in relation to the performance of a position, the performance of a profession or activities related to the upbringing, education, treatment or care of minors, or who acts on the premises of a school or other institution or educational or care institution, is subject to a prison sentence of up to 3 years.<\/p>\n Art. 2.
