{"id":49737,"date":"2022-12-15T20:59:34","date_gmt":"2022-12-15T19:59:34","guid":{"rendered":"https:\/\/www.outono.net\/elentir\/?p=49737"},"modified":"2024-12-15T01:26:51","modified_gmt":"2024-12-15T00:26:51","slug":"the-articles-of-the-constitution-that-sanchez-violates-to-liquidate-judicial-independence","status":"publish","type":"post","link":"https:\/\/www.outono.net\/elentir\/2022\/12\/15\/the-articles-of-the-constitution-that-sanchez-violates-to-liquidate-judicial-independence\/","title":{"rendered":"The articles of the Constitution that S\u00e1nchez violates to liquidate judicial independence"},"content":{"rendered":"<p>Today in Spain a serious blow to the rule of law and, specifically, to the separation of powers, by the left has been consummated.<!--more--><\/p>\n<p><rel><a href=\"https:\/\/www.outono.net\/elentir\/2022\/12\/15\/abascal-denounces-a-coup-to-the-rule-of-law-and-the-constitution-in-spain\/\">Abascal denounces \"a coup to the Rule of Law and the Constitution\" in Spain<\/a><\/rel><br \/>\n<rel><a href=\"https:\/\/www.outono.net\/elentir\/2022\/12\/09\/yesterday-peru-and-now-spain-coup-by-the-leftist-govt-against-judicial-independence\/\">Yesterday Peru and now Spain: coup by the leftist govt against judicial independence<\/a><\/rel><\/p>\n<p><big>They liquidate judicial independence in a hurry and through the back door<\/big><\/p>\n<p>In a way never seen before, <strong>two organic laws have been modified, that of Power<br \/>\nJudiciary (1985) and the Constitutional Court (1979), by urgent means and through<\/strong> <a href=\"https:\/\/www.congreso.es\/public_oficiales\/L14\/CONG\/BOCG\/B\/BOCG-14-B-295-4.PDF#page=1\" rel=\"noopener\" target=\"_blank\">two mere amendments (number 61 and number 62)<\/a>, tabled by the socialists of the PSOE and by the communists of Podemos <a href=\"https:\/\/www.congreso.es\/busqueda-de-iniciativas?p_p_id=iniciativas&p_p_lifecycle=0&p_p_state=normal&p_p_mode=view&_iniciativas_mode=mostrarDetalle&_iniciativas_legislatura=XIV&_iniciativas_id=122\/000271\" rel=\"noopener\" target=\"_blank\">to a bill<\/a> prepared by themselves and in which the mandatory reports of the advisory bodies of the State have been omitted when modifying such relevant laws. They liquidate judicial independence in a hurry and through the back door.<\/p>\n<p><big>A reform that violates Articles 122 and 159 of the Spanish Constitution<\/big><\/p>\n<p>The two amendments approved by the left and its separatist partners <strong>eliminate the requirement of a qualified vote of three fifths for the election of the members of the General Council of the Judiciary (CGPJ) and the Constitutional Court (TC)<\/strong> , in such a way that the government will be able to control both judicial bodies with a simple majority. <strong>It is a reform that clearly violates the Spanish Constitution<\/strong>, <a href=\"https:\/\/www.outono.net\/elentir\/2022\/12\/15\/abascal-denounces-a-coup-to-the-rule-of-law-and-the-constitution-in-spain\/\">as the parliamentary opposition has warned<\/a>.<\/p>\n<p>Specifically, <strong>this change violates<\/strong> <a href=\"https:\/\/www.outono.net\/elentir\/documents\/spanish-constitution\/\">Article 122 and Article 159 of the Spanish Constitution<\/a>, which establish that the members of the CGPJ and the TC elected by Congress and the Senate will be \"by a majority of three-fifths of its members\". This is what Article 122.3 states:<\/p>\n<blockquote><p><em>\"The General Council of the Judiciary shall consist of the President of the Supreme Court, who shall preside it, and of <strong>twenty members appointed by the King for a five-year term<\/strong>, amongst whom shall be twelve judges and magistrates of all judicial categories, under the terms established by the organic law; <strong>four nominated by the Congress of Deputies and four by the Senate, elected in both cases by three-fifths of their members<\/strong> from amongst lawyers and other jurists of acknowledged competence and over fifteen years of professional experience.\"<\/em><\/p><\/blockquote>\n<p>Likewise, Article 159.1 states the following:<\/p>\n<blockquote><p><em>\"The Constitutional Court shall consist of twelve members appointed by the King. Of these, four shall be nominated by Congress <strong>by a majority of three-fifths of its members<\/strong>, four shall be nominated by the Senate <strong>with the same majority<\/strong>, two shall be nominated by the Government, and two by the General Council of the Judiciary.\"<\/em><\/p><\/blockquote>\n<p><big>The reform contradicts what the PSOE said in the preamble of a law<\/big><\/p>\n<p>In 1985 <strong>the PSOE already altered that election system<\/strong> through the Organic Law of the Judiciary, which established that the 20 members of the CGPJ would be elected by the Cortes, that is, by politicians. However, <strong>that law established that a three-fifths majority would be necessary for his election<\/strong>, in accordance with the provisions of the Constitution. In the preamble to that law, <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1985-12666\" rel=\"noopener\" target=\"_blank\">its editor, who was the PSOE, stated<\/a>:<\/p>\n<blockquote><p><em>\"<strong>The requirement of a highly qualified majority of three-fifths<\/strong> \u2013which the Constitution requires for the election of the other members\u2013 <strong>guarantees, at the same time as absolute coherence with the general character of the system democracy<\/strong>, the convergence of diverse forces and avoids the formation of a General Council that responds to a concrete and circumstantial parliamentary majority.\"<\/em><\/p><\/blockquote>\n<p><big>In 2016 the PSOE said that this three-fifths majority was necessary to preserve pluralism<\/big><\/p>\n<p>Furthermore: <a href=\"https:\/\/hj.tribunalconstitucional.es\/HJ\/docs\/BOE\/BOE-A-2016-12361.pdf\" rel=\"noopener\" target=\"_blank\">in an appeal filed by the PSOE to the TC in 2016<\/a>, the socialists argued that this three-fifths majority was also necessary in the appointment of Supreme Court Justices and senior judicial officials: <em>\"<strong>it must be done with the reinforced majority of three-fifths over the total members of the Council, in order to preserve pluralism<\/strong> within the judicial organization and harmonize the requirements for the appointment of members of the Courts that culminate the constitutional rule of law.\"<\/em><\/p>\n<p>In other words: <strong>the PSOE contradicts what that party stated 6 years ago and launches to liquidate the constitutional rule of law<\/strong>, using its own words.
