{"id":51056,"date":"2023-04-02T07:38:18","date_gmt":"2023-04-02T05:38:18","guid":{"rendered":"https:\/\/www.outono.net\/elentir\/?p=51056"},"modified":"2024-04-02T00:20:20","modified_gmt":"2024-04-01T22:20:20","slug":"perez-de-los-cobos-case-a-scandal-that-points-to-the-highest-level-of-the-spanish-government","status":"publish","type":"post","link":"https:\/\/www.outono.net\/elentir\/2023\/04\/02\/perez-de-los-cobos-case-a-scandal-that-points-to-the-highest-level-of-the-spanish-government\/","title":{"rendered":"P\u00e9rez de los Cobos case: a scandal that points to the highest level of the Spanish government"},"content":{"rendered":"<p>This week, the Supreme Court of Spain has handed down a ruling in favor of Colonel Diego P\u00e9rez de los Cobos against his illegal dismissal.<!--more--><\/p>\n<p><rel><a href=\"https:\/\/www.outono.net\/elentir\/2023\/03\/16\/the-reasons-why-the-spanish-left-wing-is-immune-to-all-its-political-scandals\/\">The reasons why the Spanish left-wing is immune to all its political scandals<\/a><\/rel><br \/>\n<rel><a href=\"https:\/\/www.outono.net\/elentir\/2022\/12\/18\/poland-yes-spain-not-the-crude-reason-why-brussels-tolerates-sanchezs-coup\/\">Poland yes, Spain not: the crude reason why Brussels tolerates S\u00e1nchez's coup<\/a><\/rel><\/p>\n<p><big>The dismissal of a colonel who was investigating two cases related to the government<\/big><\/p>\n<p>This case dates back to May 2020, when the Minister of the Interior of Spain, <a href=\"https:\/\/www.europapress.es\/nacional\/noticia-marlaska-cesa-perdida-confianza-coronel-perez-cobos-jefe-guardia-civil-madrid-20200525131456.html\" rel=\"noopener\" target=\"_blank\">Fernando Grande-Marlaska, dismissed Colonel Diego P\u00e9rez de los Cobos<\/a>, head of the Madrid Civil Guard command, alleging \"loss of confidence\". <strong>P\u00e9rez de los Cobos was then investigating two legal cases that implicated the government:<\/strong><\/p>\n<ul>\n<li><strong>The first involved the government delegate in Madrid, the socialist Jos\u00e9 Manuel Franco<\/strong>, from the feminist demonstrations on March 8 of that year despite the high risk of contagion due to the pandemic.<\/li>\n<li><strong>The second was the management of the pandemic by Fernando Sim\u00f3n<\/strong>, director of the Health Alerts and Emergencies Coordination Center of the Ministry of Health, for his management of the pandemic.<\/li>\n<\/ul>\n<p>The \"loss of confidence\" alleged by the government had to do with <strong>the colonel's refusal to provide the minister with the reports that had been prosecuted and declared secret on these two cases<\/strong>. If that Civil Guard command had delivered that report to the minister, he would have incurred criminal responsibilities, since the colonel was acting as a Judicial Police and <a href=\"http:\/\/web.archive.org\/web\/20200605041251\/https:\/\/www.efe.com\/efe\/espana\/politica\/la-jueza-del-8m-avisa-a-interior-guardia-civil-solo-debe-informarle-ella\/10002-4255342\" rel=\"noopener\" target=\"_blank\">the magistrate had given an order that only she be informed<\/a>. Finally, after the dismissal of P\u00e9rez de los Cobos, <a href=\"https:\/\/www.outono.net\/elentir\/2020\/05\/26\/lo-que-medios-afines-al-gobierno-ocultan-del-informe-de-la-guardia-civil-sobre-el-8m\/\">the report was illegally leaked to a pro-government media<\/a>, and other government-affiliated media dedicated themselves to trying to discredit it.<\/p>\n<p><big>Criticism from the political opposition, judges and prosecutors<\/big><\/p>\n<p>The management of the pandemic by Pedro S\u00e1nchez's cabinet was receiving an avalanche of criticism, after learning that <a href=\"https:\/\/www.elmundo.es\/espana\/2020\/04\/02\/5e862a5121efa005338b465b.html\" rel=\"noopener\" target=\"_blank\">the government ignored the WHO five times in February<\/a>, after that body declared an international emergency over the pandemic on January 30. Everything indicates that <strong>the government wanted to avoid having to face criminal responsibilities for this action<\/strong>, and it had no qualms about breaking the law by ordering that Civil Guard coronal to commit an illegality by delivering that report to the minister.<\/p>\n<p>The dismissal of the Colonel generated <a href=\"https:\/\/www.outono.net\/elentir\/2020\/05\/25\/marlaska-cesa-otra-vez-a-un-mando-de-la-guardia-civil-que-podria-perjudicar-al-psoe\/\">harsh criticism from the parliamentary opposition<\/a>, <a href=\"https:\/\/confilegal.com\/20200526-las-asociaciones-judiciales-piden-que-se-aclare-el-cese-del-coronel-de-la-guardia-civil-perez-de-los-cobos\/\" rel=\"noopener\" target=\"_blank\">from judicial associations<\/a> and also <a href=\"https:\/\/www.europapress.es\/nacional\/noticia-asociacion-fiscales-ve-intromision-ilegitima-gobierno-cese-perez-cobos-alerta-precedente-20200526231641.html\" rel=\"noopener\" target=\"_blank\">from the Association of Prosecutors<\/a>. In addition, the government's decision caused deep discomfort in the Civil Guard. The day after the colonel's dismissal, <a href=\"https:\/\/www.libertaddigital.com\/espana\/2020-05-26\/terremoto-en-la-guardia-civil-el-dao-dimite-por-el-cese-del-coronel-perez-de-los-cobos-1276658361\/\" rel=\"noopener\" target=\"_blank\">the Deputy Director of Operations (DAO) of the Benem\u00e9rita, Lieutenant General Laurentino Ce\u00f1a, presented his resignation<\/a> in solidarity with P\u00e9rez de los Cobos. Likewise, there was <a href=\"https:\/\/www.outono.net\/elentir\/2020\/05\/29\/los-actos-de-apoyo-a-la-guardia-civil-se-extienden-ya-por-ciudades-de-toda-espana\/\">demonstrations in support of the Civil Guard in various cities in Spain<\/a>, attended by citizens outraged by the abuse of power committed by the government.<\/p>\n<p><big>The minister lied in Congress and in the Senate<\/big><\/p>\n<p>Given the scandal that arose and its possible criminal effects, <strong>the minister denied that the dismissal of the colonel had anything to do with that report<\/strong>, a denial expressed by <a href=\"https:\/\/www.lavanguardia.com\/politica\/20200530\/481451534154\/marlaska-da-por-zanjada-la-crisis-de-perez-de-los-cobos.html\" rel=\"noopener\" target=\"_blank\">both in Congress< \/a> and <a href=\"https:\/\/www.rtve.es\/noticias\/20200529\/marlaska-niega-sanchez-ordenara-cesar-perez-cobos-anade-nadie-pidio-informe-del-8m\/2015190.shtml\" rel=\"noopener\" target=\"_blank\">as in the Senate<\/a>.<\/p>\n<p>The colonel took his case to court, and on March 31, 2021, <a href=\"https:\/\/www.outono.net\/elentir\/2021\/03\/31\/la-sentencia-de-la-an-sobre-el-coronel-perez-de-los-cobos-por-la-que-marlaska-deberia-dimitir\/\">the National Court published a sentence that agreed with P\u00e9rez de los Cobos<\/a>. The judicial decision indicated that the dismissal occurred <em>\"for not reporting on the development of investigations and actions of the Civil Guard in the operational framework and of the Judicial Police\"<\/em>, something expressed in writing in a resolution of the Secretary of State for Security on May 24, 2020. Likewise, <strong>the National Court described the reason for the dismissal as <em>\"non-existent, insufficient, inconsistent, inaccurate, incomplete and arbitrary\"<\/em> and a <em>\"deviation of power\"<\/em><\/strong> by the government.<\/p>\n<p>That ruling clearly demonstrated that Marlaska had not only illegally ordered the dismissal of that colonel, but also that <strong>the minister had lied in parliament about the reason for the colonel's dismissal<\/strong>. These are two very serious events in a democratic country and should be followed by the dismissal of the minister. <a href=\"https:\/\/www.libertaddigital.com\/espana\/2020-06-02\/pp-vox-y-cs-exigen-la-dimision-inmediata-de-marlaska-1276658747\/\" rel=\"noopener\" target=\"_blank\">The parliamentary opposition called for Marlaska's resignation<\/a>, but <a href=\"https:\/\/www.elmundo.es\/espana\/2020\/06\/02\/5ed66684fdddff11b48b45c1.html\" rel=\"noopener\" target=\"_blank\">the minister refused to resign<\/a> and, in a exhibition of cynicism, <a href=\"https:\/\/www.libertaddigital.com\/espana\/2020-06-02\/el-gobierno-reduce-a-una-conspiracion-las-mentiras-e-injerencias-de-marlaska-y-defiende-su-trabajo-exquisito-y-rigor-1276658766\/\" rel=\"noopener\" target=\"_blank\">the government declared itself the victim of a \"conspiracy\"<\/a>, an increasingly common strategy to avoid any criticism of its scandals and mismanagement.<\/p>\n<p><big>The Supreme Court agrees with the colonel<\/big><\/p>\n<p>Finally, this Tuesday, March 28, <a href=\"https:\/\/www.poderjudicial.es\/cgpj\/es\/Poder-Judicial\/Noticias-Judiciales\/El-Tribunal-Supremo-anula-el-cese-de-Perez-de-los-Cobos-como-jefe-de-la-Comandancia-de-la-Guardia-Civil-de-Madrid\" rel=\"noopener\" target=\"_blank\">the Supreme Court sided with the colonel of the Civil Guard<\/a>, dismissing the appeal filed by the State Attorney's Office and annulling the dismissal of P\u00e9rez de los Cobos. <a href=\"https:\/\/drive.google.com\/file\/d\/15Ar1KPUMW6qGYd_EIwkBP5TRhbC8Nssf\/view\" \" rel=\"noopener\" target=\"_blank\">The ruling can be read here (view PDF)<\/a>. In it (page 18) it is reiterated that the reason for the dismissal of the colonel was his refusal to provide the minister with a report subject to judicial secrecy. Thus, this ruling <strong>confirms that not only was something illegal demanded of the colonel, but also that the minister lied when he denied that he had been required to do so.<\/strong><\/p>\n<p><big>The minister does not resign and defames the colonel<\/big><\/p>\n<p>After these serious events indicated by the Supreme Court, <strong>it is unheard of that Marlaska has not yet been resigned or dismissed as a minister<\/strong>. Not only that, but also, one day after that sentence was known, <a href=\"https:\/\/www.elmundo.es\/espana\/2023\/03\/29\/6423ebdd21efa031498b45b5.html\" rel=\"noopener\" target=\"_blank\">Marlaska changed her version and launched into defaming P\u00e9rez de los Cobos<\/a>, suggesting that he was dedicated to destroying evidence in a court case related to the Popular Party. <strong>A serious accusation that the minister launched without evidence<\/strong> and <a href=\"https:\/\/www.elmundo.es\/espana\/2023\/03\/31\/6426cc8721efa0ca4f8b4592.html\" rel=\"noopener\" target=\"_blank\">which he has retracted<\/a> after appearing in some media that P\u00e9rez de los Cobos was considering suing the minister.<\/p>\n<p>What happened with this scandal <strong>not only exposes a serious abuse of power, but also a perverse habit of the coalition government <\/strong> made up of socialists and communists, which for several years has launched harsh attacks against judicial independence. <strong>It is intolerable that a minister accused of illegally dismissing a Civil Guard commander should remain in office, <\/strong> a dismissal that occurred because that commander refused to commit a crime. It is also intolerable that Marlaska has not yet restored P\u00e9rez de los Cobos to his post, after publishing a final sentence that proves him right, and that instead he launches <strong>to slander a colonel who has been tried to infamous by the government and its related media for simply abiding by the law<\/strong> and doing their duty.<\/p>\n<p><big>An action typical of a government like that of Venezuela<\/big><\/p>\n<p>The actions of the Minister of the Interior are typical of a dictatorship like Venezuela. But Marlaska is not the only one responsible for this scandal. <strong> If the minister continues in his position, it is because Pedro S\u00e1nchez has decided so<\/strong>, which suggests that the ultimate responsibility for this scandal is the president of the government himself. <strong> It is unthinkable that the Minister of the Interior would have acted as he did without S\u00e1nchez's knowledge and consent<\/strong>, because if that had not been the case, what has come to light would already have led to the dismissal of Marlaska.<\/p>\n<p>Thus, <strong>this case is not only about an arrogant and abusive minister, but about an autocratic government<\/strong>, which does not respect the rule of law and believes that its wishes and will are above legality . <strong>S\u00e1nchez is yet another example of the toxic mentality of a socialist party, the PSOE, which believes that anything goes to stay in power<\/strong> and that anyone who stands in its way must be removed and ousted, twisting the law or simply trampling it. <strong> S\u00e1nchez and his party are a danger to democracy in Spain <\/strong>, and the P\u00e9rez de los Cobos case is one more example of this.<\/p>\n<p>---<\/p>\n<p><small>Photo: Efe.
