{"id":52234,"date":"2023-07-01T17:14:23","date_gmt":"2023-07-01T15:14:23","guid":{"rendered":"https:\/\/www.outono.net\/elentir\/?p=52234"},"modified":"2024-07-01T00:13:25","modified_gmt":"2024-06-30T22:13:25","slug":"lgbt-flags-in-public-buildings-pedro-sanchez-incites-to-disobey-a-court-ruling","status":"publish","type":"post","link":"https:\/\/www.outono.net\/elentir\/2023\/07\/01\/lgbt-flags-in-public-buildings-pedro-sanchez-incites-to-disobey-a-court-ruling\/","title":{"rendered":"LGBT flags in public buildings: Pedro S\u00e1nchez incites to disobey a court ruling"},"content":{"rendered":"<p>The socialist Pedro S\u00e1nchez has once again exhibited today his particular idea of respect for the Rule of Law and in particular for Justice.<!--more--><\/p>\n<p><rel><a href=\"https:\/\/www.outono.net\/elentir\/2022\/12\/15\/the-articles-of-the-constitution-that-sanchez-violates-to-liquidate-judicial-independence\/\">The articles of the Constitution that S\u00e1nchez violates to liquidate judicial independence<\/a><\/rel><br \/>\n<rel><a href=\"https:\/\/www.outono.net\/elentir\/2022\/12\/24\/king-felipe-vi-warns-against-the-erosion-of-institutions-in-the-middle-of-the-sanchez-coup\/\">King Felipe VI warns against \"the erosion of institutions\" in the middle of the S\u00e1nchez coup<\/a><\/rel><\/p>\n<p><big>A president of the government calling to disobey a Supreme Court ruling<\/big><\/p>\n<p>In a message posted on his Twitter account, <a href=\"https:\/\/twitter.com\/sanchezcastejon\/status\/1674787295264919556\" rel=\"noopener\" target=\"_blank\">S\u00e1nchez referred to the pacts between the Party Popular and Vox<\/a> in some institutions, stating: <em>\"<strong>Removing an LGTBI flag from a fa\u00e7ade of a public institution is taking away rights<\/strong>.\"<\/em> The president of the Spanish government has not explained what rights are suppressed by not placing <strong>a flag that is not even official<\/strong> on public buildings. Let us remember that the rights are included in the Constitution and in the laws, and their validity is not affected by the use of an unofficial flag.<\/p>\n<p>In addition to insinuating that an official flag has an obligation that it absolutely lacks, <strong>with his statement, S\u00e1nchez is inciting disobeying a Supreme Court ruling<\/strong>. This is <a href=\"https:\/\/www.poderjudicial.es\/search\/AN\/openDocument\/7124cad3b84436e7\/20200602\" rel=\"noopener\" target=\"_blank\">sentence 1163\/2020<\/a>, approved by the Contentious Chamber on May 26, 2020. In the Fundamentals of Law part, the text of the judgment states the following: <em>\"<strong>it is not compatible with the current constitutional and legal framework<\/strong>, and in particular, with the duty of objectivity and neutrality of the Public Administrations <strong>the use, even occasional, of unofficial flags outside buildings and public spaces<\/strong>, even when they do not replace, but that they concur, with the flag of Spain and the others legally or statutorily instituted.\"<\/em><\/p>\n<p><big>The sentence is not limited to prohibiting the hoisting of these unofficial flags<\/big><\/p>\n<p>As can be seen, <strong>the sentence is not limited to referring to the hoisting, but also to the \"use\" of unofficial flags<\/strong> <em>\"outside buildings and public spaces\"<\/em >, something he considers illegal. Thus, <strong>with his statement, Pedro S\u00e1nchez is skipping that \"constitutional and legal framework\" indicated in the sentence<\/strong>. It is something extremely serious that a president of the government calls to disobey a judicial sentence of the highest court. Let us remember <strong>Article 9.1 of the Constitution: <em>\"Citizens and public authorities are bound by the Constitution and all other legal provisions.\"<\/em><\/strong><\/p>\n<p><big>S\u00e1nchez's party refuses to put the Spanish flag on dozens of town halls<\/big><\/p>\n<p>In case this insubordination of the president of the government to legality does not come, it must be remembered that <a href=\"https:\/\/www.abc.es\/espana\/cataluna\/esconde-bandera-espana-ayuntamientos-gobierna-solitario-20230210201804-nt.html\" rel=\"noopener\" target=\"_blank\">S\u00e1nchez's party refuses to place the Spanish Flag in dozens of town halls<\/a> in Catalonia.
