{"id":57448,"date":"2024-10-16T18:17:28","date_gmt":"2024-10-16T16:17:28","guid":{"rendered":"https:\/\/www.outono.net\/elentir\/?p=57448"},"modified":"2024-10-22T21:34:38","modified_gmt":"2024-10-22T19:34:38","slug":"encuesta-el-fiscal-general-del-estado-debe-dimitir-tras-ser-imputado-por-un-delito","status":"publish","type":"post","link":"https:\/\/www.outono.net\/elentir\/2024\/10\/16\/encuesta-el-fiscal-general-del-estado-debe-dimitir-tras-ser-imputado-por-un-delito\/","title":{"rendered":"Encuesta: \u00bfEl Fiscal General del Estado debe dimitir tras ser imputado por un delito?"},"content":{"rendered":"<p>El Tribunal Supremo <a href=\"https:\/\/www.poderjudicial.es\/cgpj\/es\/Poder-Judicial\/Noticias-Judiciales\/El-Tribunal-Supremo-abre-causa-contra-el-fiscal-general-del-Estado-por-un-presunto-delito-de-revelacion-de-secretos\" rel=\"noopener\" target=\"_blank\">ha anunciado hoy<\/a> que abre causa contra el Fiscal General del Estado por un presunto delito de revelaci\u00f3n de secretos.<!--more--><\/p>\n<p><rel><a href=\"https:\/\/www.outono.net\/elentir\/2024\/10\/16\/el-gobierno-usa-un-bulo-para-defender-al-fiscal-general-del-estado-tras-su-imputacion\/\">El gobierno usa un bulo para defender al Fiscal General del Estado tras su imputaci\u00f3n<\/a><\/rel><br \/>\n<rel><a href=\"https:\/\/www.outono.net\/elentir\/2024\/03\/28\/espana-la-finca-particular-de-los-socialistas-la-lista-de-instituciones-que-han-colonizado\/\">Espa\u00f1a, la finca particular de los socialistas: la lista de instituciones que han colonizado<\/a><\/rel><\/p>\n<p>Adem\u00e1s de la imputaci\u00f3n de \u00c1lvaro Garc\u00eda Ortiz, tambi\u00e9n est\u00e1 imputada la Fiscal Jefa provincial de Madrid, Pilar Rodr\u00edguez Fern\u00e1ndez. <a href=\"https:\/\/www.poderjudicial.es\/cgpj\/es\/Poder-Judicial\/Noticias-Judiciales\/El-Tribunal-Supremo-abre-causa-contra-el-fiscal-general-del-Estado-por-un-presunto-delito-de-revelacion-de-secretos\" rel=\"noopener\" target=\"_blank\">La nota del Tribunal Supremo<\/a> <strong>se\u00f1ala como causa de la imputaci\u00f3n la posible relevaci\u00f3n de correos<\/strong> entre el fiscal de un caso y el letrado del particular acusado en ese caso, unos correos que <strong>presuntamente habr\u00edan sido filtrados por la Fiscal\u00eda a los medios<\/strong>. <\/p>\n<p>Hay que se\u00f1alar que <strong>la imputaci\u00f3n se ha acordado por unanimidad en la Sala de lo Penal del Tribunal Supremo<\/strong>, pues en junio <a href=\"https:\/\/www.eldebate.com\/espana\/20240610\/fiscal-general-autoinculpa-filtraciones-novio-ayuso-pide-causa-vaya-supremo_203960.html\" rel=\"noopener\" target=\"_blank\">el propio Fiscal General asumi\u00f3 la responsabilidad en la filtraci\u00f3n de esos correos<\/a>, a pesar de saber que dicha filtraci\u00f3n era un delito de revelaci\u00f3n de secretos por autoridad o funcionario p\u00fablico, tipificado en el <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1995-25444#a417\" rel=\"noopener\" target=\"_blank\">Art\u00edculo 417 del C\u00f3digo Penal<\/a> y que <strong>podr\u00eda acarrear una pena de prisi\u00f3n de hasta 4 a\u00f1os<\/strong>. Se da la circunstancia de que en todos los a\u00f1os que llevamos de democracia en Espa\u00f1a, <strong>es la primera vez que un Fiscal General del Estado es imputado por un delito<\/strong>.
