This was nothing new in human history. <strong>The Soviet communist dictatorship had already implemented a totalitarian penal system very similar to the Nazi<\/strong> one, in which anyone could be convicted of a crime without evidence.<\/p>\n<p><big>The presumption of innocence in the Universal Declaration of Human Rights<\/big><\/p>\n<p>Following the defeat of the <strong>National Socialist dictatorship<\/strong>, the United Nations, at a General Assembly held in Paris, adopted the <a href=\"https:\/\/www.outono.net\/elentir\/documents\/universal-declaration-of-human-rights\/\">Universal Declaration of Human Rights<\/a> on 10 December 1948, based on the idea that <em>\"recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family\"<\/em> is the foundation of freedom, justice and peace in the world.<\/p>\n<p><strong>Article 11 of that Declaration addresses the right to the presumption of innocence<\/strong>, that is, that no person shall be convicted without evidence:<\/p>\n<blockquote><p><em><strong>Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal<\/strong>, in the determination of his rights and obligations and of any criminal charge against him.<\/em><\/p><\/blockquote>\n<p>In 1978, the Spanish people overwhelmingly approved the <a href=\"https:\/\/www.outono.net\/elentir\/documents\/spanish-constitution\/\">Spanish Constitution<\/a> in force today, which <strong>protects the right to the presumption of innocence in its Article 24.2<\/strong>, within a section dedicated to fundamental rights and public freedoms.<\/p>\n<p><big>A court acquits a footballer due to lack of evidence.<\/big><\/p>\n<p>On Friday, <a href=\"https:\/\/www.poderjudicial.es\/cgpj\/es\/Poder-Judicial\/Tribunales-Superiores-de-Justicia\/TSJ-Cataluna\/Noticias-Judiciales-TSJ-Cataluna\/El-TSJ-de-Cataluna-revoca-por-unanimidad-la-sentencia-que-condeno-a-un-futbolista-por-agresion-sexual\" rel=\"noopener\" target=\"_blank\">a footballer was acquitted by the High Court of Justice of Catalonia (TSJC)<\/a> of the crime of sexual assault of a young woman in a nightclub in Barcelona on December 31, 2022. The ruling states that <em>\"<strong>from the evidence presented, it cannot be concluded that the standards required by the presumption of innocence have been exceeded<\/strong> in accordance with Directive (EU) 2016\/343 of the European Parliament and of the Council of 1994. Europe of March 9, 2016.\"<\/em><\/p>\n<p><big>A socialist minister tramples on the right to the presumption of innocence<\/big><\/p>\n<p>Yesterday, at a rally of the Spanish Socialist Workers' Party (PSOE), a member of Pedro S\u00e1nchez's government, <a href=\"https:\/\/x.com\/europapress\/status\/1905975897905131717\" rel=\"noopener\" target=\"_blank\">the socialist minister Mar\u00eda Jes\u00fas Montero criticized the sentence<\/a> with these words collected by the Europa Press agency in this video:<\/p>\n<blockquote class=\"twitter-tweet\" data-media-max-width=\"665\">\n<p lang=\"es\" dir=\"ltr\">Mar\u00eda Jes\u00fas Montero ve &quot;una verg\u00fcenza&quot; la sentencia que absuelve a Dani Alves y que &quot;todav\u00eda se cuestione el testimonio de una v\u00edctima y se diga que la presunci\u00f3n de inocencia est\u00e1 por delante del testimonio de mujeres j\u00f3venes&quot;: &quot;Estamos contigo&quot; <a href=\"https:\/\/t.co\/MmtQaBOTdy\">https:\/\/t.co\/MmtQaBOTdy<\/a> <a href=\"https:\/\/t.co\/p6h9vB4OOJ\">pic.twitter.com\/p6h9vB4OOJ<\/a><\/p>\n<p>&mdash; Europa Press (@europapress) <a href=\"https:\/\/twitter.com\/europapress\/status\/1905975897905131717?ref_src=twsrc%5Etfw\">March 29, 2025<\/a><\/p><\/blockquote>\n<p> <script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<blockquote><p><em>\"Dani Alves's sentence is shameful. <\/em>(...)<em> <strong>How shameful that the testimony of a victim is still questioned and that it is said that the presumption of innocence is ahead of the testimony of young, brave women<\/strong> who decide to denounce the powerful, the great, the famous.\"<\/em><\/p><\/blockquote>\n<p>It should be remembered that <strong>members of the Spanish government must swear or promise to abide by and enforce the Constitution<\/strong> the moment they take office.
