{"id":62102,"date":"2025-11-27T06:50:47","date_gmt":"2025-11-27T05:50:47","guid":{"rendered":"https:\/\/www.outono.net\/elentir\/?p=62102"},"modified":"2025-11-28T23:16:39","modified_gmt":"2025-11-28T22:16:39","slug":"the-silence-of-the-cgpj-in-the-face-of-the-governments-attacks-on-the-supreme-court","status":"publish","type":"post","link":"https:\/\/www.outono.net\/elentir\/2025\/11\/27\/the-silence-of-the-cgpj-in-the-face-of-the-governments-attacks-on-the-supreme-court\/","title":{"rendered":"The silence of the CGPJ in the face of the government's attacks on the Supreme Court"},"content":{"rendered":"<p>Today marks one week since the Supreme Court announced <a href=\"https:\/\/www.outono.net\/elentir\/2025\/11\/20\/spains-attorney-general-convicted-sanchezs-position-further-undermined\/\">the conviction of the Attorney General<\/a>.<!--more--><\/p>\n<p><rel><a href=\"https:\/\/www.outono.net\/elentir\/2025\/11\/20\/spains-attorney-general-convicted-sanchezs-position-further-undermined\/\">Spain's attorney general convicted: S\u00e1nchez's position further undermined<\/a><\/rel><br \/>\n<rel><a href=\"https:\/\/www.outono.net\/elentir\/2025\/11\/21\/the-left-wing-and-the-pigs-who-believe-that-some-animals-are-more-equal-than-others\/\">The left-wing and the pigs who believe that some animals are more equal than others<\/a><\/rel><\/p>\n<p>\u00c1lvaro Garc\u00eda Ortiz has achieved something unprecedented: <strong>the first time a State Attorney General has been convicted of a crime<\/strong>, specifically for revealing secrets as part of a government campaign against a political rival. <strong>The Supreme Court's ruling demonstrates that the law applies to everyone, including the powerful.<\/strong> In this sense, the court has restored hope in our rule of law for many Spaniards.<\/p>\n<p>That ruling has received an intolerable response in a democracy. <strong>The government, its allies, and all its affiliated media have spent a week launching serious slanders against the Supreme Court, even accusing them of staging a \"coup,\"<\/strong> <a href=\"https:\/\/www.eldebate.com\/espana\/20251121\/tellado-lamenta-tve-television-publica-hable-golpismo-judicial-irresponsabilidad_357549.html\" rel=\"noopener\" target=\"_blank\">using even a public broadcaster, RTVE, paid for by all taxpayers<\/a> but which acts as a propaganda arm for the socialists.<\/a> <strong>What the left is doing in Spain is a serious attack against judicial independence<\/strong> and a clear violation of the right to honor of the judges who are part of that court, <a href=\"https:\/\/www.antena3.com\/noticias\/espana\/yolanda-diaz-llama-movilizacion-social-pacifica-fallo-supremo-garcia-ortiz_202511256925ee9edf41134465e910ff.html\" rel=\"noopener\" target=\"_blank\">they are even using the press conferences of the Council of Ministers to make these attacks<\/a>.<\/p>\n<p>Faced with these attacks, which demonstrate once again that <strong>Spain has a left wing that does not accept democratic norms<\/strong> (because these norms apply to everyone, and include court rulings issued by the courts), <strong>the silence of the General Council of the Judiciary (CGPJ), the highest governing body of judges in Spain, is especially astonishing<\/strong>. In a week, it has not issued even the slightest complaint against the worst smear campaign the judiciary has suffered in decades, <strong>a campaign encouraged by Pedro S\u00e1nchez's own government<\/strong>.<\/p>\n<p><a href=\"https:\/\/www.poderjudicial.es\/cgpj\/es\/Poder-Judicial\/Consejo-General-del-Poder-Judicial\/\" rel=\"noopener\" target=\"_blank\">The CGPJ website states the following<\/a>: <em>\"The General Council of the Judiciary is a constitutional, collegiate, autonomous body, composed of judges and other legal professionals, which exercises the functions of governing the Judiciary with <strong>the aim of guaranteeing the independence of judges in the exercise of their judicial function against all others<\/strong>.\"<\/em><\/p>\n<p>For a week now, we have witnessed <strong>an attempt to delegitimize a court for issuing a ruling that the government dislikes<\/strong>, simply because that ruling has exposed a despicable political operation in which the Attorney General played a prominent role. <strong>And in the face of this, the General Council of the Judiciary remains silent<\/strong>, as if this serious attack on the justice system did not affect it, as if it were not its problem.<\/p>\n<p>I don't know how this will end, but <strong>when a government attacks judicial independence as the S\u00e1nchez government is doing<\/strong>, resorting to all its means to try to delegitimize and intimidate judges and magistrates, <strong>what it is actually doing is attacking democracy, specifically one of its pillars, which is the separation of powers<\/strong>. No democrat should be complicit in something like this, either actively (by participating in this campaign of harassment against the judiciary) or passively (by remaining silent about it).<\/p>\n<p><strong>The CGPJ must react now to this anti-democratic offensive, and if it fails to do so, it will be betraying its duty<\/strong> and leaving other judges and magistrates vulnerable, because what we are witnessing is not only an attack on judges for issuing a ruling that displeases the government, but also <strong>an attempt to intimidate all judges in Spain so that they dare not challenge the left<\/strong>.
