Podemos incites people to commit a crime punishable by up to three years in prison

There are politicians who believe themselves to be above the law and who openly advocate violence, believing it will come at no cost.

This Wednesday, Juan Pablo Fernández Santos, spokesperson for Podemos and representative of that far-left party in the Cortes of Castilla y León, openly called for blocking the passage of the Vuelta Ciclista a España in the streets of Valladolid, where a time trial of that sporting event that takes place this Thursday takes place. The spokesperson for Podemos himself has acknowledged on his Twitter account his call to block La Vuelta.

These messages are intolerable in a democratic country. What this Podemos spokesperson is doing is encouraging violence and inciting the commission of a crime, something for which he should be brought before the courts to answer for that crime as an instigator. Specifically, Fernández is inciting the commission of a crime of public disorder, classified in Article 557 of the Penal Code, which is punishable by up to three years in prison. This is what the aforementioned article says:

Article 557.

1. Those who, acting in a group and with the aim of attacking public peace, carry out acts of violence or intimidation shall be punished with imprisonment from six months to three years:

a) About people or things; or

b) obstructing public roads, causing danger to the life or health of people; or

c) invading facilities or buildings, seriously disrupting the effective functioning of essential services in those places.

2. The acts described in the previous section shall be punished with imprisonment of three to five years and special disqualification from public employment or office for the same period when committed by a crowd whose number, organization, and purpose are suitable to seriously affect public order. If the perpetrators are found to be in authority, the penalty of disqualification shall be absolute for a period of six to eight years.

3. The penalties in the previous sections will be imposed in their upper half on those involved who carry dangerous instruments or those who carry out acts of looting.

These penalties will be applied to a greater extent when firearms are carried.

4. Provocation, conspiracy and proposal for the conduct provided for in sections 2 and 3 of this article shall be punished with penalties one or two degrees lower than those respectively provided for.

5. Anyone who causes an avalanche, stampede, or other similar public reaction in a crowded place that endangers the life or health of people shall be punished with imprisonment from six months to two years.

6. The penalties indicated in this article shall be imposed without prejudice to those that may apply to specific acts of injury, threats, coercion or damage that may have been carried out.

In a democratic country, it is unacceptable for a political leader to publicly incite people to commit crimes, believing that they are above the law or perhaps with the idea that the end justifies the means. Furthermore, a party that openly calls for violent acts is a party that should be outlawed. The risk of not applying the law to far-left thugs is that they will set an example and that others will stop respecting the law, given that the government turns a blind eye when its allies incite people to commit crimes.

For the rest, I think it is necessary to remember that Podemos, which falsely accuses Israel of committing "genocide" for its military response to Hamas terrorist attacks, refused to support the European accusation of genocide against the Islamist terrorists of ISIS for exterminating thousands of Christians and Yazidis in the Nineveh Plains massacre in Iraq in 2016. In 2021 Podemos opposed the European condemnation of the crimes of communism, a resolution that recalled the crimes of genocide perpetrated by that totalitarian movement. Likewise, in 2022 Podemos also did not support the European resolution that classified the Ukrainian Holodomor perpetrated by Stalin as genocide in 1932 and 1933, with millions of deaths.
