Degrading democratic institutions has serious consequences, but that process does not usually begin suddenly.
A TC turned into a battering ram to demolish democracy
As I warned this morning, this Thursday the so-called Constitutional Court (TC), controlled by the socialists, has approved Sánchez's unconstitutional amnesty for his separatist partners, an amnesty that clearly violates Article 62 of the Spanish Constitution, which expressly prohibits general pardons. Both this amnesty and this ruling that whitewashes it are two of the most serious examples of socialist corruption that is degrading our democratic institutions and turning Spain into something increasingly similar to the socialist dictatorship of Venezuela.
Like all institutions colonized by the PSOE, the TC has been corrupted by the Socialists to become a simple whitewashing office for its abuses, whatever they may be. If tomorrow Pedro Sánchez were to pass a law to imprison those who disagree with him, I have no doubt that the leftist majority of this pseudo-court would find a way to whitewash it. This TC is no longer a dam to defend democracy, but a battering ram to demolish it.
As I pointed out here last year, right now we have a Constitutional Court controlled by the government and that obediently follows its dictates, a Constitutional Court whose purpose is no longer to protect the Spanish people from abuses of political power, but to bless those abuses when they are committed by the socialist government. This means that political power in Spain no longer has limits: Sánchez can do whatever he wants, because even if a criminal court condemns him for it, the TC will overturn any sentence as it already did with the socialist corruption in the ERE case.
In 2022, the PP handed over control of the TC to the PSOE until 2031
It must be said that we owe this situation not only to the PSOE: let us remember that in December 2022, the Popular Party (PP) handed over control of the TC to the socialists until 2031 (as stated by the socialist newspaper El País after that agreement between the PP and PSOE to renew the court), thus obtaining an excuse to leave the socialist ideological laws intact even though they have an absolute majority to govern and repeal them, as already happened during the terms of José María Aznar and Mariano Rajoy. One of the first laws whitewashed by that Constitutional Court was the 2010 abortion law, a monstrous law that qualifies the killing of unborn children as a "right" and which the PP refused to repeal during Rajoy's term.
Coincidentally, this socialist control of the TC was achieved with the support of the PP a few months after Alberto Núñez Feijóo became president of that party. In case anyone has forgotten this, Feijóo was one of the PP leaders who opposed the repeal of the 2010 abortion law during Rajoy's term, and he did so by pressuring his party to break its election promise to "strengthen the protection of the right to life" (see the 2011 PP program, page 108). From those dusts come those muds.
The PP called for Pumpido's resignation in 2006 but supported his entry into the TC in 2017
However, if Cándido Conde-Pumpido is in the TC, of which he is currently president and whose rulings have become a cause of scandal in Spain, it is because in 2017, during Mariano Rajoy's term, the Popular Party supported his appointment as a member of that body despite his disastrous performance when he was Attorney General of the State between 2004 and 2011, during the socialist government of José Luis Rodríguez Zapatero.
In 2006, Conde-Pumpido had made his subordination to political power clear with controversial statements in which he stated that "Justice is not there to favor political processes, but neither is it there to hinder them", adding that "the flight of the prosecutors' robes will not avoid contact with the dust of the road."
It should be remembered that the PP called for Conde-Pumpido's resignation over those statements, accusing him of being "the defense attorney for the president of the government". Eleven years later, that same PP supported his appointment as a member of the TC, which enabled him to take over that body in January 2023. In the end, the dust from Conde-Pumpido's robes has ended up dirtying the entire TC until it became what it is today: a mere agency at the service of the PSOE.
