Equating a democratic country with the terrorists who attacked it

The prosecutor of the International Criminal Court (ICC), Karim Ahmad Khan, has made arrest requests against Israel's Prime Minister, Benjamin Netanyahu, and against Israel's Defense Minister, Yoav Gallant, for "war crimes and crimes against humanity". The most striking aspect of the request issued by Khan is that the same text also calls for the arrest of three leaders of the terrorist organization Hamas, whom he also accuses of "war crimes and crimes against humanity" for the terrorist attack against Israel on October 7, 2023 and the taking of hostages.

In its entire history, it is the first time that the International Criminal Court puts a democratic government and a terrorist organization on the same level, something that has been criticized by several democratic countries, including Israel itself.

The prosecutor is a Muslim who was a lawyer for two accused of crimes against humanity

The news should not come as a surprise if we take into account that Khan is Muslim and of Pakistani origin and was undersecretary general of the United Nations , an organization known for its blatant bias against Israel.

Likewise, and as The New York Times recalls today, Khan was a lawyer: "Among his high-profile clients were Seif al-Islam el-Qaddafi, son of the late Libyan dictator Muammar el-Qaddafi; and Charles Taylor, the former president of Liberia, who fired him."

Paradoxically, Seif al-Islam el-Qaddafi has been wanted since 2011 by the International Criminal Courtfor crimes against humanity, like Charles Taylor, who boycotted his trial by refusing to go to court, after being accused of instigating the murder, rape, mutilation and recruitment of child soldiers in the civil war in Sierra Leone between 1991 and 2002, which left 50,000 dead.

Not a single arrest warrant against the tyrants of China, Iran and Syria

This afternoon, Orde F. Kittrie, former US State Department attorney and senior law professor at Arizona State University, published an interesting thread on Twitter in which he pointed out the following:

"The only serving national leaders for which the ICC has previously issued such arrest warrants are Libya’s Muammar Gaddafi, Russia’s Vladimir Putin, and Sudan’s Omar al-Bashir. Israel’s leaders do not belong in such company.

The ICC has never issued arrest warrants for: Iran’s Supreme Leader Ayatollah Ali Khamenei or any other Iranian official, Syrian President Bashar al Assad or any other Syrian official, or the genocidal General Secretary of the People’s Republic of China, Xi Jinping, or any other Chinese official.

While Iran, Syria, and the PRC are, like Israel, not ICC members, the ICC has only concocted a jurisdiction claim, a specious claim at that, for Israel, and is now advancing warrants against leaders of democratic Israel as it defends itself against Hamas, Iran, and others which have vowed to destroy the Jewish state. This is outrageous."

“Israel has implemented more precautions to prevent civilian harm than any military in history”

On the way in which Israel has been carrying out its war against the Hamas terrorists, Kittrie points out the following:

"Contrary to the ICC's warrant submission, Israel has conducted the Gaza war in an exceptionally careful manner. According to John Spencer, chair of urban warfare studies at West Point, “Israel has implemented more precautions to prevent civilian harm than any military in history —above and beyond what international law requires and more than the U.S. did in its wars in Iraq and Afghanistan.”

In contrast with the ICC warrant submission, the May 10 State Department report on Israel’s use of American-made weapons concluded that the available information was insufficient to definitively identify even one specific Israeli violation of international humanitarian law (IHL), also known as the law of war. It described Israel’s robust IHL compliance procedures, says the U.S. “has no direct indication of Israel intentionally targeting civilians,” and states that Israel aborts strikes when civilians are observed near the target."

Professor Kittrie concludes by warning the following about the arrest request issued by Khan against two members of the Israeli government:

"ICC warrants for Israeli officials will embolden Hamas, Hezbollah, and Iran, and thereby torpedo efforts to secure a hostage release. Such warrants also could cripple the ability of the Saudis and other Arabs to proceed with peace efforts."
