This fact can be seen in the statement of the Royal House announcing the decision of H.M. the King:

The key to everything is in the third paragraph that I just quoted: the King has not "verified" that Sánchez has more support than Feijóo. Obviously, Sánchez could have told him that he has the support of other groups, but that is not enough. If this round of consultations exists, it is for each group to establish its position. If you do not attend, your position is not recorded.

The fact is that this round of consultations has had the participation of Popular Party, the PSOE, Vox< /a>, Add, the PNV, Canary Coalition (CC) and Navarro People's Union (UPN). Nobody else. Of the parties that have appeared in this round of consultations, the PP (137 seats) has the support of Vox (33), CC (1) and UPN (1): 172 seats in total. A in turn, the PSOE (121 seats) has the support of Sumar (31) and possibly the PNV (5), which adds up to 157 seats. ERC (7), Junts (7), EH Bildu (6) and BNG (1) have not participated in these consultations, so their position is not known to the King.

Of course, in a democratic country one can be an anti-system extremist who does not recognize constitutional institutions, starting with the Head of State. If you want these institutions to know your position, you will have to notify them through the channels established by the Constitution (Article 99, in this case). And if you don't want to, then your position will continue without being recorded for the purposes of forming a government.

In fact, Sánchez will continue to have this problem if Feijóo's inauguration fails. As long as he continues to seek the support of anti-system extremists who do not recognize constitutional mechanisms, he will continue to lack sufficient support in the eyes of the institution in charge of assigning the investiture to a candidate , which is the Head of State . And it is because the Spanish decided it in the democratic referendum by which the Constitution was approved. Everything else is childish tantrums of those who want to obtain power outside the law, something typical of anti-democrats.
