Goodbye to equality in Spain: the acts that will not be forgiven by the amnesty law

Today the amnesty law prepared by the Socialist Party (PSOE) and its separatist and extreme left allies has been leaked to the media.

Impunity for crimes committed by separatists for 12 years

The law (you can read the full text here) is in reality, an impunity law to erase the crimes committed during 12 years by Catalan separatism and even prevent the courts from investigating any issue related to them. The very wide range of crimes that will go unpunished includes crimes of political corruption (such as the usurpation of public functions and embezzlement of public funds) and even violent crimes (such as the attack on authority and terrorism crimes). All these crimes will be erased by the PSOE's surrender to the blackmail of the fugitive Puigdemont.

A colossal fraud on the rule of law

The law includes 11 pages full of lies and manipulations to justify it in its explanatory statement. Lies and manipulations that contradict the own statements of members of the government (including Pedro Sánchez) pointing out the unconstitutionality of the amnesty, before this measure was demanded by the separatists as a price to support Sánchez's re-election. The explanatory statement of this law is a colossal fraud on the rule of law.

An attack against the constitutional right to equality before the law

One of the constitutional precepts that will be seriously harmed by this law is the one protected by Article 14 of the Constitution, which says the following:

"Spaniards are equal before the law and may not in any way be discriminated against on account of birth, race, sex, religion, opinion or any other personal or social condition or circumstance."

This law breaks the right to equality by leaving unpunished and preventing the investigation of crimes committed by allies of the government, simply because Pedro Sánchez imposes his personal interest over legality, because needs the support of the separatists. The mere presentation of this law in the Congress of Deputies is a blatant act of political corruption, by suspending the application of the law for certain people with the sole purpose of Sanchez obtaining a benefit staff.

The acts that will not be forgiven and those that will

It must be said that this law will not forgive or erase many acts contrary to current legislation. In fact, the most appropriate way to evaluate this law is to consider the acts it omits from its grant of impunity to a wide range of criminals:

  • If you have received a fine for not wearing a seat belt in your car, the fine will not be forgiven, even if you claim political motivations for your behavior. This will happen while the law forgives crimes of public disorder in which urban furniture was set on fire.
  • If by mistake you stopped paying a tax, you will be punished, because you are not an influential separatist politician capable of twisting the arm of the government to turn a blind eye to certain crimes. You will be punished while the embezzlers of millions of euros go unpunished.
  • If you insult a police officer in the exercise of his duty, you may be fined, with a fine of up to 18 months under Article 504 of the Penal Code. However, crimes of attacks against authority committed by separatists will be forgiven and erased, even those committed against agents who were injured for life.
  • If an armed robber enters your business and you beat him up, you can be arrested and sent to trial (there have already been cases in Spain), even though you claim that he was defending your personal integrity. All of this while the amnesty law forgives and erases terrorist crimes, prohibiting investigation of them, even some related to the possession of explosives.

A de facto repeal of Article 14 of the Constitution

Thus, this amnesty law implies the de facto and backdoor repeal of Article 14 of the Constitution, suppressing the right that we all have to be treated equally by the law, regardless of who we are. let's be And all this because Sánchez needs a handful of votes from the separatists to be re-elected, and he has decided that we Spaniards will be the ones to pay the price for the blackmail posed by the PSOE allies. With what moral authority will the State impose any sanction for any infraction from now on? This infamous law converts the sanctioning power of the State into a mere arbitrary exercise, by virtue of which some politicians erase the crimes of other politicians because they need their support: pure and simple corruption.
