I know what I am risking by writing this article, but the seriousness of the moment that Spain is experiencing implies taking risks in its defense.

The darkest day for democracy in Spain since the coup of 1981

This Thursday, March 7, 2024, with the announcement of the pact between socialists and separatists to amnesty crimes of terrorism and treason, democracy in Spain has experienced its darkest day since the coup d'état of February 23, 1981, when Congress experienced a violent assault with the aim of subjecting all Spaniards to a process of subversion of the constitutional order.

This time there are no shots, but this time the blow to democracy is directed from the government and is leading to the demolition of the rule of law in Spain, with an amnesty that grants criminal privileges to some criminals allied with the government, privileges that imply a flagrant violation of the Spanish Constitution and particularly of our right to equality before the law (Article 14) and the express constitutional prohibition of general pardons strong> (Article 62).

A colossal deception typical of the novel "1984"

We must also remember every day that the government itself insisted that the amnesty was "unconstitutional", until it was necessary to obtain the support of the Catalan separatists for Sánchez's reelection. Since that moment, which took place in last year's general elections, the government has diametrically changed its discourse. It is not a mere change of opinion: it is a colossal deception typical of George Orwell's novel "1984", in which a totalitarian regime tried to convince the population that war is peace, freedom is slavery and ignorance is strength. We are facing the biggest and most shameless lie that a government has launched in all the years we have had democracy.

A confluence of interests between two groups marked by serious crimes

This blow to our rule of law takes place at a confluence of interests between two groups marked by serious crimes. The first of these groups is socialismthat is in power, which is starring the worst corruption scandal in its history, a history that in itself has already been plagued by corruption scandals corruption in the last decades. The second group is Catalan separatism, author of a blow to democracy in 2017 that sought to suspend the validity of the Constitution in Catalonia in order to break the unity of Spain. Both groups intend to mutually benefit from this amnesty that violates our Constitution.

Firstly, the separatists intend to erase all their criminal records to remain unpunished for the serious crimes they committed during that 2017 coup, crimes that include embezzlement of public funds, sedition, terrorism and treason . This latest crime has been uncovered with the investigation by the Civil Guard on contacts between separatists to obtain economic and military support from the Kremlin to guarantee the success of the 2017 coup.

In turn, the socialists intend to avoid having to go to new elections that would probably make them lose power because of their corruption scandals and the deception committed against their voters last year, by saying before of the elections that the amnesty was "unconstitutional" and then launched to approve it.

The risk that socialists run if they lose power

That loss of power could cause them to lose their current control of many institutions, including the State Attorney General's Office, the Constitutional Court and the Court of Accounts. Furthermore, that would truncate their assault on the Judiciary, one of the last institutions, along with the Crown, that the socialists still do not control. All this without excluding the possibility that the socialists end up granting another amnesty to themselves, taking advantage of the serious precedent they are creating by granting it to their allies in exchange for their support.

Furthermore, this loss of power could bring to light even more corruption crimes by the socialists, at a time when several ministries have already been affected by the mask purchase scandal. Some members of the government could end up in prison, including Sánchez himself, since among those identified by Justice there are people who were part of his circle of trust. Thus, this attack on the rule of law aims to ensure that there are no new elections in the short term, that the Spaniards are handcuffed and have to attend as mere spectators to this subversion of our constitutional order.

Article 570 bis and what it says about criminal organizations

Taking into account everything we have just seen, I think it is necessary to remember what Article 570 bis of the Penal Code says:

"For the purposes of this Code, a criminal organization is understood to be a group formed by more than two people on a stable basis or for an indefinite period of time, which in a concerted and coordinated manner distribute various tasks or functions. for the purpose of committing crimes."

This same Article 570 bis adds the following:

"Those who promote, constitute, organize, coordinate or direct a criminal organization shall be punished with a prison sentence of four to eight years if its purpose or object is the commission of serious crimes, and with a prison sentence of three to six years in other cases; and those who actively participate in the organization, form part of it or cooperate economically or in any other way with it shall be punished with a prison sentence of two to five years if its purpose is the commission of serious crimes, and with a prison sentence of one to three years in other cases."

The separatists have already started to threaten the judges

Taking into account what is happening in Spain, there are reasons to affirm that our country is in the hands of a criminal organization that has used the levers of power to commit serious crimes of corruption and that now intends to >subvert current legality to leave their allies unpunished, in the most serious corruption scandal of our democracy, which is the amnesty announced yesterday by the socialists and their separatist partners. An announcement after which the separatists have already begun to threaten judges who resist this attack against our constitutional legality.

This criminal organization must be brought before the courts

The political opposition, the associative movement, judges and legal organizations should begin to consider initiating a criminal case against this criminal organization that intends to use our institutions for its benefit, causing great damage to our framework constitutional and coexistence among Spaniards, and putting at serious risk the unity of Spain, which yesterday was threatened with the announcement of a new blackmail by Puigdemont to the government.

Spain is experiencing a very serious moment and, in the face of this, what is unjustifiable is to remain impassive. The institutions that are not yet under the control of that organization have to respond immediately to this attack against our Nation and our democracy.
